Legal-judicial justice is the aspiration of every society, and is accordance with the historical-civilizational tradition of that society. In its historical encounter with modernity, Iranian society, without genuine awareness of the nature of bureaucracy, and under the influence of the narrative of modernist intellectuals, surrendered to legal-judicial bureaucracy, hoping that this bureaucratic order would lead to the realization of legal-judicial justice; unaware that bureaucracy is rooted in the nature of the standard action of modern society and rational-legal authority, and is formed and developed in the light of formal rationality. legal and judicial bureaucracy not only failed to achieve legal and judicial justice in the contemporary history of Iran, but also became a fundamental obstacle to the realization of justice. The secular nature of the legal-judicial bureaucracy, the dominance of bureaucratic justice over true justice, the hardening of laws, and the creation of a legal-judicial iron cage in Iran are the most important challenges of the legal-judicial bureaucracy in the current state of Iranian society, which results in numerous social harms. The only way out of this iron cage is to revive a social order based on the Iranian-Islamic tradition and in the light of the enlightened and mystical identity of Iranians. Rebuilding value-based, ethical, religious actions based on deep human emotions and creating a network of faithful relationships in a religious perspective of history and in the light of divine guardianship, will provide the basis for Iranian society to move beyond the bureaucratic order and realize justice.
